1. General Terms
These terms of service (hereinafter "Terms") govern the use of the evoluna.app website and related services (hereinafter "Platform").
The Platform is operated by XPERT MEDIA OÜ, registry code 12852895, address Kirsi tn 8-90, 10616 Tallinn, Estonia (hereinafter "Evoluna", "we" or "platform").
By using the Platform, you agree to these Terms. If you do not agree with the Terms, please do not use the Platform.
2. Nature and Role of the Platform
IMPORTANT: Evoluna is a marketplace platform, not a service provider.
Evoluna connects users with independent specialists (mentors, coaches, consultants, advisors, etc.). We:
•Are NOT the employer or representative of specialists
•Do NOT provide mentoring, coaching, or consulting services ourselves
•Do NOT guarantee specialists' qualifications, certifications, or results
•Do NOT control the content of services offered by specialists
•Are NOT responsible for advice, recommendations, or actions of specialists
Specialists are independent service providers who are fully responsible for the content, quality, legality of their services, and communication with clients.
3. User Responsibility and Obligations
Before booking a service, the user must:
•Independently research and verify the specialist's background, qualifications, and experience
•Ensure that the selected service meets their needs and expectations
•Assess whether the service is safe and suitable for them
•Read the specialist's profile, reviews, and service description
•Consult with the specialist before booking if necessary
The user confirms that they:
•Are at least 18 years old
•Provide accurate and truthful information
•Will not use the Platform for illegal purposes
•Respect the rights of other users and specialists
•Will not distribute offensive, threatening, or illegal content
Age verification: The Platform is intended only for adults (18+). We are not responsible if a minor provides false information about their age. Upon discovering such information, we will delete the account immediately.
4. Specialist Responsibility and Obligations
The specialist agrees to:
•Provide truthful information about their qualifications, experience, and certifications
•Offer services according to their competence and applicable legislation
•Follow their field's code of ethics and best practices
•Protect clients' personal data and privacy
•Comply with all laws and regulations of the Republic of Estonia
•Provide accurate tax information and fulfill their tax obligations
The specialist confirms that:
•Their services are not medical or healthcare services (unless properly licensed)
•They do not provide medical diagnoses or treatment (except licensed healthcare professionals)
•They highlight when their services do not replace professional medical, psychological, or legal assistance
5. Medical and Health Disclaimer
IMPORTANT WARNING:
Services offered on the Evoluna platform (coaching, mentoring, consulting, wellness services, body awareness, self-development, etc.) are NOT:
•Medical or healthcare services
•Psychotherapy, psychological treatment, or crisis intervention
•Diagnosis, treatment, or rehabilitation
•Substitutes for professional medical care, psychological assistance, or emergency services
Health and Wellness Boundaries:
The platform encompasses fields relating to body, mind, spirit, and general well-being. Some specialists may offer services that are health- or wellness-related in nature (e.g., nutritional counselling, body awareness, yoga, meditation, bioenergetics). These services are preventive, educational, or supportive in nature — not medical.
Regulated Services Exception:
Where a specialist holds a valid licence to provide regulated healthcare or therapy services, they are solely responsible for regulatory compliance, informed consent, and professional oversight. Evoluna does not mediate or supervise regulated healthcare services.
Emergency Situations:
The platform is NOT designed for crisis or emergency situations. If you are experiencing suicidal thoughts, an acute psychiatric episode, or any other medical emergency, call emergency services immediately at 112 or go to your nearest emergency department.
Automated Crisis Detection:
Evoluna uses an automated crisis detection system that analyses user activity on the platform (including assessment results and chatbot messages) to identify potential crisis signals. When a crisis signal is detected, Estonian crisis support contacts are automatically displayed to the user (112, Lasteabi 116 111, Ohvriabi 116 006, Emotional Support 116 123, etc.). This system does not replace professional crisis intervention and does not store separate data about detected crisis signals. Crisis detection is based on GDPR Article 6(1)(f) (legitimate interest in ensuring user safety).
Each user is responsible for their own health and well-being and for decisions made based on specialists' recommendations.
6. Limitation of Liability
Evoluna is NOT responsible for:
•The quality, content, or results of services provided by specialists
•Advice, recommendations, or actions of specialists
•Disputes between users and specialists
•Direct or indirect damages resulting from the use of services
•The accuracy of specialists' qualifications
•The consequences of decisions made by users
•Service interruptions of third parties (Stripe, Google, etc.)
Evoluna's liability is limited:
In any case, Evoluna's maximum liability is limited to the amount paid by the user to the platform in the last 12 months.
Exception: The limitation of liability does not apply in cases of intentional wrongful conduct or gross negligence.
7. Payments and Fees
Payment processing:
All payments are processed through the secure payment service provider Stripe. Evoluna does not directly store or process bank card data. This includes one-time booking payments, subscription recurring payments, and custom package payments.
Platform service fee:
Evoluna takes a platform fee (commission) from each booking, which is deducted from the amount paid to the specialist. The current commission rate depends on the specialist's subscription tier and is visible in the specialist's profile.
Subscription recurring payments:
Specialist subscription tiers (Basic, Standard, Premium) are billed on a recurring monthly or annual basis via Stripe. Subscriptions auto-renew at the end of each billing period unless cancelled. Upon cancellation, the subscription remains active until the end of the current billing period. See §10 (Subscriptions and Tiers) for details.
Custom package payments:
Specialists can create custom packages with individual pricing, payable via Stripe. The package price includes the platform service fee based on the specialist's active subscription tier.
Refunds:
•Cancellation more than 72 hours before the session: 100% refund
•Cancellation 24-72 hours before the session: 50% refund
•Cancellation less than 24 hours before the session: no refund (rescheduling only)
•Refunds for custom packages are resolved on a case-by-case basis between the specialist and client
•Subscription refunds: pro-rata refund for unused period, except during free trial periods
•Disputes are resolved on a case-by-case basis
Currency:
All prices are in euros (EUR) unless otherwise indicated.
8. Intellectual Property
Evoluna intellectual property:
The Evoluna platform, trademark, logo, design, and software belong to XPERT MEDIA OÜ. Use without written permission is prohibited.
AI-based profile enrichment:
Evoluna uses artificial intelligence (AI) technology to analyze, systematize, and enrich publicly available data. This includes extracting skills and competencies, classifying archetypes, and structuring profiles. The AI-generated analysis, systematized skill lists, and data structure are Evoluna's intellectual property (Sui generis database right, EU Directive 96/9/EC). Automated copying of this data by third parties is prohibited.
Evoluna strives to ensure the accuracy of AI analysis but does not guarantee 100% interpretive accuracy. Specialists have the right to claim their profile and correct data at any time.
AI-based matching:
Evoluna uses artificial intelligence to match users with specialists based on assessment results and profile data. AI-generated match explanations, matching scores, and recommendation algorithms are Evoluna's intellectual property. See §12 (AI-Based Matching) for detailed terms.
User content:
Users and specialists remain owners of their uploaded content (images, texts, videos), but grant Evoluna a non-exclusive right to use this content for platform operation.
Reviews:
Reviews are public and remain on the platform even after the user's account is closed, but are anonymized.
9. Assessments and Profile Visibility
Assessment System:
Evoluna offers users self-assessment tools that help them better understand their strengths, areas for development, and personal goals. Assessment results are personal and confidential.
Profile Visibility Control:
Users have the option to enable the display of their assessment results on their public profile. This feature is disabled by default and enabling it is a conscious choice by the user.
Publicly Displayed Information:
When a user enables assessment result display:
•Only the assessment name, profile type, and overall score are shown
•Detailed answers, dimension scores, and internal analyses are not disclosed
•The user can disable visibility at any time
User Responsibility:
The user is solely responsible for what information they display publicly on their profile. Evoluna is not responsible for any consequences that may arise from the user's decision to share their assessment results publicly.
10. Subscriptions and Tiers
Subscription system:
Evoluna offers specialists three subscription tiers: Basic, Standard, and Premium. Each tier offers a different platform service fee rate, additional features, and visibility benefits.
Billing:
•Subscriptions are billed on a recurring monthly or annual basis
•Payments are processed automatically via Stripe
•Annual subscriptions offer a more favorable monthly rate
Auto-renewal:
Subscriptions auto-renew at the end of each billing period unless the user has previously cancelled.
Cancellation:
•Users can cancel their subscription at any time through profile settings
•Cancellation takes effect at the end of the current billing period
•After cancellation, the account reverts to the Basic tier
•Upon cancellation, data and profile are preserved, but higher-tier features are deactivated
Free trial period:
Evoluna may offer free trial periods to new specialists. At the end of the trial period, automatic billing begins unless the user cancels. Users are explicitly notified before trial activation.
Price changes:
Evoluna may change subscription prices by notifying current subscribers at least 30 days in advance. The new price takes effect at the beginning of the next billing period.
Right of Withdrawal (EU Consumers):
In accordance with Directive 2011/83/EU of the European Parliament and of the Council (Consumer Rights Directive), you as a consumer have the right to withdraw from the contract within 14 days without giving any reason.
However, by agreeing to the activation of the subscription and the immediate availability of the digital service, **you expressly waive your 14-day right of withdrawal** pursuant to Article 16(m) of Directive 2011/83/EU. This means that after the subscription is activated and you begin using the service, you may no longer request a refund on the basis of the right of withdrawal.
•The waiver of the right of withdrawal applies only to the current billing period
•Cancellation for future periods is always possible in accordance with the cancellation terms above
•During the free trial period, the subscription can be cancelled free of charge
11. Custom Packages
Custom packages system:
Specialists can create personalized packages that combine multiple services into a single offering with individual pricing.
Package terms:
•The content, price, and terms of the package are determined by the specialist
•Evoluna facilitates payment and applies the platform service fee based on the specialist's subscription tier
•The package must be clearly described so the client understands what it includes
•The specialist is responsible for the content and quality of the package
Payment:
•Packages are paid via Stripe
•The specialist determines whether the package is payable as a one-time or installment payment
•Refunds for custom packages are resolved on a case-by-case basis in accordance with §7
Evoluna's role:
Evoluna is an intermediary and is not responsible for the content, quality, or results of custom packages. Disputes are resolved in accordance with §19.
12. AI-Based Matching
Matching system:
Evoluna uses artificial intelligence (AI) to generate personalized recommendations based on user assessment results and specialist profiles. Matching is based on analysis of assessment dimensions, goals, and specialist competencies.
AI-generated content:
•Match scores and explanations are generated automatically by AI
•AI explanations are advisory, not binding
•Evoluna does not guarantee the accuracy or suitability of AI recommendations
•The user is responsible for the final choice of specialist
Data usage:
•Matching uses only data that the user has provided to Evoluna (completing assessments, profile data)
•The AI model does not make decisions that have legal effect on the user
•Users have the right to opt out of matching by contacting us at [email protected]
Profiling (GDPR Art. 22):
AI-based matching constitutes profiling within the meaning of GDPR. However, it is not fully automated decision-making, as the final choice is always made by the user. Users have the right to request human intervention and challenge AI recommendations.
Limited liability:
Evoluna is not liable for the consequences of decisions made based on AI recommendations. AI recommendations are an aid, not a substitute for independent decision-making.
13. Referral System
Specialist referral system:
Specialists can refer other platform specialists to their clients. The referral system enables collaboration and cross-referencing.
Referral terms:
•A referral is a voluntary action by the specialist
•The referrer is responsible for the relevance of the referral to the best of their judgment
•Evoluna does not guarantee the suitability of the referred specialist
•The client is free to disregard the referral
Data usage:
•Referral data (referrer, referee, status) is stored on the platform
•Both parties are notified of the referral by email
•Referral history is visible in both specialists' profiles
14. Custom Profile URLs (Vanity URLs)
Custom URLs:
Specialists can set up a custom profile URL (e.g., evoluna.app/name) through their profile settings.
Terms:
•The URL must consist of 3-50 characters (lowercase letters, numbers, and hyphens)
•The URL must not contain offensive, misleading, or trademark-infringing content
•Reserved words (e.g., admin, api, help, etc.) are prohibited
•The URL must be unique — each URL can belong to only one specialist
Change restrictions:
A custom URL can be changed once every 365 days. The old URL is released immediately after the change and is no longer available.
Removal:
Evoluna reserves the right to remove custom URLs that violate these terms, third-party rights, or are misleading. Upon account closure, the custom URL is released.
15. Campaigns and Promotions
Campaign system:
Evoluna may offer campaigns that include free trial periods, discounts, and temporary subscription tier upgrades.
Campaign terms:
•The terms of each campaign (validity period, discount amount, usage limitations) are specified in the campaign description
•Campaigns are time-limited and may end at any time
•Campaigns are personal and non-transferable to another user
•Campaign abuse (e.g., creating duplicate accounts) is prohibited and may lead to account closure
Free trial periods:
•Trial periods are limited in duration and apply only to new users
•At the end of the trial period, automatic billing begins unless the user cancels
•Each user is granted one trial period

In cases of automated data collection, Evoluna reserves the right to claim damages. In cases of contact reveal or messaging system abuse, automated temporary restrictions will be applied (see section 27).
17. Platform Intervention

19. Dispute Resolution
Applicable law:
These Terms are governed by the laws of the Republic of Estonia.
Dispute resolution:
1. **Negotiations:** We first try to resolve disputes through negotiations between the parties.
2. **Consumer protection:** Consumers have the right to contact the Consumer Protection and Technical Regulatory Authority (www.ttja.ee).
3. **Court:** Unresolved disputes are settled in Harju County Court.
Disputes between users:
Disputes between users and specialists are to be resolved by the parties themselves. Evoluna may offer mediation but is not obligated to do so.
20. Platform Development and Functional Updates
Continuous Platform Development:
Evoluna is a continuously evolving digital platform. We regularly develop new features, services, and capabilities to improve the user experience and service quality.
Minor Functional Updates:
Evoluna may add new features, service categories, user interface improvements, and technical optimizations without prior consent, provided such changes do not alter the fundamental nature of existing services or the user's rights. Users will be informed of such changes through in-platform notifications.
Material Changes Requiring Notice:
The following changes are considered material and require advance notice as per §21:
•Processing of new categories of personal data
•Addition or modification of automated decision-making systems (GDPR Art. 22)
•Significant changes to pricing models of paid services

Evoluna may change these Terms at any time. For significant changes:
•We will notify you by email at least 14 days in advance
•We will display a notice on the platform
•We will update the "Last updated" date on this page
Continued use of the Platform after changes take effect means acceptance of the new Terms. If you do not agree with the changes, stop using the platform.
22. Marketing Communications
Sending marketing communications:
Evoluna may send users marketing communications and newsletters about our services, offers, and updates.
Consent:
•We ask for your explicit consent to send marketing communications during registration
•Consent is not required to create an account
•You have the right to opt out of marketing communications at any time
Opting out:
You can opt out of marketing communications by:
•Changing settings on your profile page (Security tab)
•Contacting us at [email protected]
For more information, please see our [Privacy Policy](/legal/privacy).
23. Unclaimed Profiles (from Public Sources)
Profiles imported from public professional directories:
Evoluna may import specialist data from public professional directories and registries to create so-called "unclaimed profiles". These profiles:
•Are clearly marked with an "Unclaimed" badge
•Include information about the data source
•Do not allow bookings
•Are created under GDPR Article 6(1)(f) (legitimate interest)
Notification (GDPR Art. 14):
Evoluna notifies data subjects of their data import via email within 14 days of the data being added to the platform. The notification email includes: platform and data controller details, processing purpose and legal basis, data subject rights (including profile claiming, data rectification and erasure), a direct link for profile management, and data protection contact information.
Claiming a profile:
If you find your unclaimed profile on the platform, you can claim it. Claiming can be initiated via:
•The secure link (magic link) included in the notification email
•A link included in client message forwarding emails
•Directly through the platform (login and confirm)
The secure link is valid for 180 days from the date of sending. After expiry, a new link can be requested.
Self-service profile removal:
Data subjects can instantly and independently remove their unclaimed profile using the secure link included in the notification email. The removal flow:
1. The data subject clicks the secure link and selects "Remove my profile"
2. A confirmation step is displayed with a clear warning that the action is irreversible
3. After confirmation:
• The profile and all associated data are deleted immediately and irreversibly
• The email address is added to a blocklist that prevents automatic re-import of the same address in the future
• A privacy request record is created (status: COMPLETED) to ensure an audit trail
• The platform administrator is automatically notified
• The data subject receives a confirmation email
Blocklist (re-import protection):
After profile removal, the data subject's email address is added to a blocklist (type: AUTO_IMPORT). This ensures that the person's data is not re-imported from public registries. The blocklist is maintained indefinitely to protect the data subject's wishes. The data subject can request removal of their email from the blocklist if they wish to rejoin the platform in the future.
Alternative removal:
If the data subject does not have a secure link, they can request data removal via:
•The privacy request page: evoluna.app/privacy-request
•Email: [email protected]
Profile retention:
Unclaimed profiles remain on the platform in unclaimed form until the profile is claimed or the data subject exercises their right of removal. Evoluna periodically reviews the data quality and relevance of unclaimed profiles.
For more information, please see our [Privacy Policy](/legal/privacy) and [Legitimate Interest Assessment (LIA)](/legal/lia).
24. Contact Information Protection and Disclosure
Three-tier contact information protection:
Evoluna implements a three-tier system to protect specialist contact information:
1. **Anonymous browsing:** Platform visitors can browse specialist profiles without seeing contact details. Phone numbers, email addresses, and website URLs are masked by default.
2. **Login required:** To view contact information, the user must be logged in with an Evoluna account.
3. **Contact reveal:** A logged-in user can request the reveal of a specific specialist's contact information. The reveal is a one-time action — once revealed, the information remains visible to that user.
Reveal logging:
Every contact information reveal action is logged in the system, including the time of reveal, user and specialist identifiers. This ensures transparency and enables abuse detection.
Automatic reveal:
In certain cases, contact information is revealed automatically:
•After sending a message to a specialist (see section 25)
Limitations:
The platform applies reasonable limits to the frequency of contact information reveals to protect specialist privacy and prevent abuse (see section 27).
25. Communicating with Specialists
Sending messages to claimed specialists:
Evoluna allows registered and logged-in users to send messages to specialists who have claimed their profile directly through the platform.
Messages are delivered to the specialist via:
•Email (to the specialist's registered email address)
•Platform notification (bell notification)
When a message is sent, the specialist's contact information is automatically revealed to the sender to enable further communication outside the platform.
Sending messages to unclaimed specialists:
Evoluna also allows sending messages to specialists who have not yet claimed their profile (unclaimed profiles). The purpose of this feature is to enable contact with the specialist and encourage them to claim their profile.
Messages sent to unclaimed profiles are delivered:
•Via email to the specialist's email address available in the system (if available)
•If the specialist does not have a real email address in the system, the message is forwarded to the Evoluna team, who will attempt to relay the contact
Sending a message to an unclaimed profile does not require the user to be logged in, but the user must complete a security verification (CAPTCHA). Sender name and email address are mandatory fields.
Message content:
•Users are responsible for the content of their messages
•Spamming, offensive content, and commercial offers are prohibited
•Evoluna does not monitor message content in real-time but reserves the right to investigate upon complaints
Limitations:
Reasonable limits apply to messaging frequency to prevent abuse (see section 27).
26. Favorites
Favorites feature:
Registered users can save specialists to their favorites list for easy future reference.
Favorites privacy:
•The favorites list is private and visible only to the user
•Specialists are not notified when they are added to someone's favorites list
•Favorites can be added and removed at any time
Data processing:
Favorites data is processed for the purpose of improving user experience in accordance with our [Privacy Policy](/legal/privacy). When an account is deleted, all favorites data is also deleted.
27. Automated Abuse Detection and Rate Limiting
Automated monitoring:
Evoluna uses automated systems to detect and prevent abuse of platform features. Monitoring covers the following activities:
•Frequency of contact information reveals
•Frequency of message sending
•Other repetitive actions
Temporary restrictions:
When the system detects unusual patterns in user activity, temporary restrictions may be applied:
•**Nature of restriction:** Temporary blocking of a specific feature (e.g., contact reveals, message sending)
•**Duration:** Restrictions are temporary and expire automatically (typically 24 hours)
•**Notification:** Users are notified of the restriction and its duration
Contesting a restriction:
If a user believes a restriction was applied in error, they can:
•Wait for the restriction to expire automatically
•Contact support: [email protected]
Data retention:
Abuse detection data (including restriction history) is retained for 90 days for diagnostic and security purposes. After this period, the data is automatically deleted.
Legal basis: GDPR Article 6(1)(f) — legitimate interest in protecting the platform and users from abuse.
28. Organizations and B2B Accounts
Organization accounts:
Evoluna allows companies and organizations to create an organization account (hereinafter "Organization") that brings team members together under a shared brand. Organization accounts are designed for business clients (B2B) who wish to offer their team's services through the platform.
Roles and permissions:
Organization members have two roles:
•**Owner:** Full management rights, including editing the organization profile, managing members, sending invitations, setting up billing, and deleting the organization
•**Member:** Belonging to the organization, visibility on the public page (if enabled)
Membership invitations:
•Members are invited via email with a personalized invitation link
•Invitations are valid for a limited time period
•Accepting an invitation is voluntary — the user must actively accept it
•The invitee must be a registered Evoluna user (specialist)
•When sending an invitation, the invitee's email address is processed in accordance with the [Privacy Policy](/legal/privacy)
Public organization page:
Each organization has a public page at /org/[name], which displays:
•Organization name, description, and logo
•Public team members (only those whose profile is marked as public)
•Filterable member list by category, location, and service
Visibility control:
•Each member can decide whether their profile is visible on the organization's public page (isPublic setting)
•The organization owner cannot force a member to be public
B2B billing:
•The organization owner can activate Stripe-based billing
•Billing is tied to the organization account, not to individual member accounts
•Subscription management is done from the organization dashboard
•Available tiers: FREE, BUSINESS, and ENTERPRISE
AI services for organizations:
Organizations can use AI-powered services according to their tier:
•Team profile generation
•Client-specialist matching
•Service summary creation
•AI service usage is feature-gated according to the organization's tier
Leaving and deleting an organization:
•A member may leave an organization at any time
•The owner may delete the organization, which removes all members and associated data
•When an organization is deleted, members' personal Evoluna accounts are preserved
Data processing:
Organization-related data (name, slug, logo, member list, invitations, billing data) is processed in accordance with the [Privacy Policy](/legal/privacy). When an organization is deleted, all organization-related data is deleted, except for legally required retention obligations (e.g., billing data for 7 years).
